Misdemeanor & Felony Classes in Texas

There are two main types of crimes in Texas: misdemeanors and felonies. While misdemeanor offenses are less serious than felony crimes, a conviction can still result in harsh criminal penalties, including fines and even a local or county jail sentence. 

The following are the three types of misdemeanor classes in Texas: 

  • Class A misdemeanor – Considered the most serious misdemeanor, a conviction is punishable by a jail term of up to one year and/or a maximum fine of $4,000. 
  • Class B misdemeanor – Getting convicted of this type of misdemeanor carries a maximum jail sentence of 180 days and/or a fine of up to $2,000. 
  • Class C misdemeanor – The least serious misdemeanor, a conviction can result in a maximum fine of $500. 

On the other hand, felonies are crimes that are punishable by state prison or state jail. Having a felony conviction on your criminal record can also result in the loss of certain rights, such as the right to carry a firearm for at least five years and the right to vote. 

The following are the four types of felony classes in TX: 

  • Capital felony – Considered the most serious felony, a conviction carries either life imprisonment without the possibility of parole or the death penalty. 
  • First-degree felony – Getting convicted of this type of felony is punishable by life imprisonment or a prison term of up to 99 years, as well as a maximum fine of $10,000. 
  • Second-degree felony – A conviction can lead to imprisonment for up to 20 years and a maximum fine of $10,000. 
  • Third-degree felonies – Getting convicted carries a maximum prison term of 10 years and a fine of up to $10,000. 
  • State jail felonies – This type of felony can either be punishable by a state jail sentence of up to two years and a maximum fine of $10,000.
